“Totality of the situation" means that she was likely unpleasant about being told to stay home. I know most law enforcement here in Canada are going the education and warning route more than the charge route.

The answer is drive faster (probably not)

Now even more fun: the cop is doing five under. Do I pass while driving the speed limit?

Absolutely, yes. 6 or 7 over, h alf an exit later you’re good to go.

This. Being an asshole to the cop, even if they might deserve it, is never a good strategic move.

I’ve also been on the other side of that back in my paralegal days for a special prosecutor (doing occasional misdemeanors , traffic citations where the defendant hired representation and mainly DWI cases). I only had two cases that were a contempt of cop situation. Both times I had to call up the officer to let them know we had to dismiss the case. Both times the conversation with the cop basically went “... yep, I know this has to go away. They were being an asshole that needed to go to jail  for the night, so I obliged them...”

Trick question. Obviously his gas pedal has something lodged behind it, giving you free reign to drop a gear, light some tires up and haul ass past him at 50 over the limit.

The big problem with a lot of cops is that many think they need to assume an aggressive posture with everyone. Body language makes all the difference when trying to project “serve and protect” vs. enforce. Cops who are over themselves are a delight to talk to and reasonable.

Also, even if a driver is being a dick, the professional will keep his cool.  Everyone says don’t piss off the cop, but the other side is that no cop should be using his badge to “win” the argument. Again, I’ve seen both good and bad at this.

Mercifully, we have a “shelter-in-place” order which allows for leisurely drives and walks, though all parks are closed and whatnot.

Sounds like the cop just wanted to mess with the kid. Anyone can lie and say they're going to pick up groceries or whatever, right? It's no one's damn business what you're doing especially if you're not harming anyone else. You can't spread COVID-19 driving alone on a back road....

It was rare, and this was for a small town without the kind of oversight one would find in large metro police department (that I went through a police academy for). Most of the work I did involved negotiating pleas and tracking down cops to get additional information and/or all of the documentation inline for DWI prosecutions (to ensure we all got to the stage of negotiating deals, which is how 90%+ of cases are disposed).

There was also the amending of criminal complaints to charge folks with the correct crimes. Those conversations with (usually the same couple of cops) tended along the lines “tell me what happened... No don’t read me the complaint;I’ve got that in front of me... in your own words, walk me through the everything that happened on the call...” Strangely, it was often a case of the officer not charging the defendant as severely as the facts supported. They might have been trying to give them something of a break, but undercharging caused problems down the road on the prosecution end where we had nothing to negotiate with to get to a deal.

I have friends that went from being marine snipers in Fallujah to being local cops. Who you get as a cop here is a shit show. You get a kid who earned his stripes as as a teen  running checkpoints in Iraq and you’re someone suffering from mental illness? Not a good combo.

Some cops are definitely attuned to their responses different. You have fighters, “I am the law” types, negotiators, social workers, slackers, et cetera. No cop is good at it all. And many cops are bad at it all and shouldn’t be cops, but that is neither here nor there.

Yup. I assume every cop is like my friends who learned to be cops by managing an Iraqi civil war as teenagers.

Haven’t had a ticket in a decade or so since I ran Mt. Lemmon at 3x the posted speed limit, thank you, Officer Taducci, for not hauling my ass to jail.

Having once spent the better part of an hour with a   gun in my face for the crime of driving 5 under on a rural road whose speed limit I didn’t know while a cop rode my bumper —Trooper Farva pulled me over only once I used a pullout so he could pass — I can confirm that in fact there is no right answer.

True. Half of what they do is mental health intervention. Each patrol  pair should be a cop and a social worker/counselor. With body cams on everybody to keep everyone honest.

I'm all for body cams and mental health training. Some larger cities in Canada run cars with a cop and social worker, but Canada is very big with a lot of rural spots, where it's hard enough to get mental health help as is.

Yes, and be grateful that the cop is doing their part to avoid being a rolling roadblock by driving a bit slow so people can pass them without breaking the law.

The order is to stay at home, not go out driving around. If it was an order to go driving around, they would have called it a drive around order.

Yeah, this is just shitty “police patrol tactics”... They’ll hang on your bumper for a couple of miles, trying to spook you into “doing something” so they can pull you over. It’s fucking annoying.

I can see why our communities of color feel oppressed by this shit.  Because if the cops will do this to some guy in a late model Audi or Suburban, what do they do to you in a 20 year old Lumina with a dent and a broken taillight?

Too much of the recent training is “seize control of the situation” instead of “analyze and evaluate”. The drilling of military equipment and tactics ain’t helping. He’s patrolling a leafy suburb, not Fallujah, FFS.

People in cars are very rarely not going anywhere. There is generally a destination. Sometimes people crash cars. Then a bunch of first responders  have to come in contact with a person who is potentially infected. Or, the person who crashed could have just stayed the fuck home like the people in charge asked and limit being outside for things that are, in fact, essential.

And she was guilty. A leisurely drive isn’t considered, by the state of Pennsylvania, to be “essential travel” as they have defined during this current period . The governor ordered that people stay at home. He didn’t order that people stay at home or go out drive around leisurely. I mean, fuck the police and all that , but in this situation, fuck some lady who thinks she is above the rules because she is just going for a drive.

No. Safety violations can actually hurt people, unlike taking a drive around the neighborhood to get out of the house.

Looking through the comments I think you are in the minority on this one. I still dont think taking a spin around your neighborhood is putting anyone in great danger. We have people upset that some people are going on walks outside instead of staying indoors, like the air is some kind of poison. Plenty of other states are allowing it.

One thing I always found amusing is that police officers call the folks they serve “civilians”, while military folks call local  police “civilians”. It strikes me as funny, but also telling that the civilian police implicitly view themselves in a militaristic role.  Again, not all police, but enough that it’s a stereotype.

I had the displeasure (unpleasure?) a few years ago to have my office broken into. An investigation ensued... The local beat cops were total dicks. Just complete ucking fassholes. On the other hand? The detective I had assigned was great- helpful, understanding, gracious. So, apparently if you are smart enough and effective enough to get out of a uniform? the cream rises.

I can’t say enough nice things about the assigned detective.  The beat cops were the worst, though.

Kinja'd!!! Chariotoflove > SBA Thanks You For All The Fish

That’s why they probably won’t make detective.

Now on the other hand, I do have to give a shout out to at least one beat cop who was directing traffic at the airport. When another gu y hit me, the cop I waved over took his own pics for both of us, wrote everything down as he brokered information transfer, and was just generally helpful. Traffic duty at the airport can not have been what he went to the academy for, but he didn’t let it show.

Michigan’s Attorney General clarified that police cannot stop motorists “just because” to see why they’re out and about. Once they have you for a lawful traffic stop, they are allowed to ask.

https://www.lansingstatejournal.com/story/news/2020/03/30/ag-michigan-police-cannot-stop-drivers-solely-stay-home-order/5087220002/

If they are doing that, it’s likely due to lack of clarity from above.

but reading the linked story by the OP, it sounds more like the driver decided to be a pain in the ass about it.

Kinja'd!!! SpecsGTP > My bird IS the word
04/04/2020 at 19:11

Without the vehicle infraction (I’m assuming an out taillight, expired registration, etc.) then the officer has no chance to stop and ask where they are traveling to.

It’s the same thing I used to teach my automotive classes: don’t give the cop a reason to stop you and you’ll have plenty of happy motoring, because the typical “good shift” is 3 tickets and an arrest. If he can do it in o ne stop...
